NextStarz Terms of Service 

This Service Agreement (“Agreement”) governs your access and use of the NextStarz Inner Circle Community (the “Community”), operated by NextStarz (“Company,” “we,” “us”). By signing up for the Community, you (“you,” “member,” “parent,” “guardian,” or “legal guardian”) agree to these terms on behalf of yourself and your minor child(ren) and represent and warrant that you have the legal authority and capacity to make this agreement.

Eligibility & Parental Responsibility

The Community is intended for parents/legal guardians. Children under 18 may access the Community only under the supervision of a parent or legal guardian. If a child under 18 wants to sign up, they must do so with the permission and supervision of a parent or legal guardian, and by that child doing so, the parent or legal guardian represents and warrants that they are bound by the contractual terms contained herein. By signing up, you represent and warrant that you are the parent or legal guardian of any minor child signing up or otherwise participating in the Community.

You represent and warrant that you are the parent or legal guardian of any minor featured in content you upload or allow to participate, and that you understand and consent to any such participation or content being viewed by other members of the Community or NextStarz, including for or in connection with related offerings.

User Content & Media Uploads

You may upload photos, videos, text, or other content (“User Content”) to the Community. By uploading, you:

• Represent that you own or have the rights to share the content.
• Confirm that any images or videos of minors have been voluntarily shared by a parent or legal guardian.
• Grant NextStarz a non-exclusive, worldwide, royalty-free license to host, display, and share your content within the Community or in connection with related offerings.
  
• Agree not to upload unlawful, harmful, infringing, or inappropriate content.

Privacy & Compliance with Child Protection Laws

NextStarz is committed to protecting the privacy and safety of children. We comply with all applicable U.S. federal and state child-protection and privacy laws, including but not limited to:

• Children’s Online Privacy Protection Act (COPPA): We do not knowingly collect personal information directly from children under 13 without verifiable parental consent. All accounts and content submissions must be created and managed by a parent or legal guardian.
• State Child Protection Regulations: We adhere to state-level requirements regarding the protection and handling of minors’ data.
• Mandatory Reporting: If we become aware of content or behavior that reasonably suggests abuse, exploitation, or endangerment of a child, we may report such information to the appropriate law enforcement or child protection agencies.

Parents are responsible for monitoring their child’s participation. You also agree not to redistribute another member’s child’s photos, videos, or personal information outside the Community.

Community Guidelines

In full, by signing up, members agree to the following guidelines, which will be made available separately in your portal after sign up, as well as in this Service Agreement.

NextStarz Inner Circle Guidelines: This is a space for players and parents who want to grow in baseball — on the field, at the plate, and in life. To keep this community safe, supportive, and valuable for everyone, please follow these guidelines:

Respect & Positivity

• Treat everyone with respect — teammates, coaches, and parents alike.
• Encourage others. No negative comments, bullying, or putting players down.
• Remember: Baseball teaches teamwork — bring that same spirit here.

Players & Parents Together

• Parents & players: Ask questions, share your wins, post questions, learn from others, support eachother, and share whats working for your family.
• Parents should guide their kids in how to use the community safely.

Stay on Topic

• This community is about baseball/softball, confidence, mentality, family, and personal growth.
• Keep posts focused on drills, mindset, routines, motivation, and game experiences.
• Off-topic or inappropriate posts will be removed.

Safety First

• No sharing of personal information (addresses, phone numbers, school names).
• Keep conversations safe for kids and family-friendly at all times.
• Coaches and moderators reserve the right to remove content or members that don’t follow these rules.

Participation

• Engage! Comment, ask questions, share what you’re working on.
• Celebrate wins — big or small — both in baseball and in life.
• Respect others’ time and opinions, even if you disagree. 

Zero Tolerance

• No bullying, name-calling, or negativity.
• No inappropriate language or images.
• No spamming, selling, or promoting outside programs without permission.

Remember: This is your team off the field. We’re here to support, encourage, and push each other to be our best.

In summary, members agree to:

• Be respectful, constructive, and supportive in posts and discussions.
• Not harass, bully, discriminate, or exploit others.
• Not share inappropriate, violent, or sexual content.
• Immediately report any concerning or unsafe behavior to NextStarz.

Violation of these rules may result in suspension or termination of access without refund, and in cases of suspected exploitation or other inappropriate behavior, reporting to child protection authorities.

Assumption of Risk

The Community provides drills, challenges, and mindset techniques designed to support confidence, character development, and athletic growth. Baseball and athletic activities inherently involve risks, including injury. By participating in any drills, exercises, or confidence-building practices, you acknowledge these risks and agree that participation is voluntary and at your own risk. You release NextStarz, its owners, operators, managers, staff, contractors, and affiliates from liability for any injuries, accidents, or damages that may occur.

No Medical, Psychological, or Therapeutic Advice

The information, drills, and confidence-building tools provided in the Community are for educational and informational purposes only. They are not intended as medical, psychological, or therapeutic advice. Always consult a qualified physician, mental health professional, or athletic trainer before beginning any exercise, training program, or mental performance practice.

No Guarantee of Results

The information, drills, and confidence-building tools provided in the Community and in or through any related NextStarz offerings are not guaranteed to produce any result or outcome. Results and outcomes are individual and will depend on each participant (parents/guardians and/or child) and a multitude of factors. Please do not take another individual result or outcome as a guarantee that you or your child will have the same result or outcome.

Intellectual Property

All drills, visualizations, videos, audio tracks, written resources, and other materials provided by NextStarz are protected intellectual property. Members may use them for personal, non-commercial purposes only. Redistribution, resale, or public sharing of materials outside the Community without written consent is strictly prohibited.

Indemnification

You agree to indemnify and hold harmless NextStarz, its owners, operators, managers, staff, contractors, and affiliates from any claims, damages, liabilities, or expenses (including legal fees) arising from:

• Your use of the Community,
• Your uploaded content,
• Your violation of this Agreement
• Your or your child’s participation in drills, challenges, or activities, including those stemming directly and indirectly from the Community or other NextStarz offerings

Termination of Access

You may cancel your subscription at any time. Access will remain until the end of the paid billing cycle. We may suspend or terminate access if you breach this Agreement, violate community guidelines, or engage in harmful behavior.

Refund Policy

All subscription payments are non-refundable. Cancellations take effect at the end of the current billing cycle. No partial refunds will be issued for unused time.

Dispute Resolution

Any disputes arising under this Agreement shall first attempt to be resolved informally. If unresolved, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, and judgment may be entered in any court of competent jurisdiction. By agreeing to arbitration, (i) the parties are waiving their right to a jury trial and to seek remedies available in court proceedings; (ii) pre-arbitration discovery is generally more limited than and different from court proceedings; (iii) the arbitrator's award will be required to include factual findings and conclusions of law; and (iv) any party's right to appeal or to seek modification of the arbitration award is strictly limited, and the award is final and binding on the parties. You acknowledge that we have explained to you that such binding arbitration may limit various rights that you otherwise might have in a legal action, including, without limitation, the right to a jury trial, the right to appeal, and full discovery rights. Your agreement to this document signifies your acknowledgment and understanding of this explanation.

Disclaimer of Liability

NextStarz is not responsible for the accuracy of User Content posted by members. You release us from liability for any disputes, claims, or damages arising from content shared by other members.

Entire Agreement

The terms of this agreement shall be interpreted as complete and binding, but if there is a provision that is unenforceable it may be stricken with the other terms remaining enforceable. This agreement cannot be changed unless the parties agree, in writing.

Governing Law

This Agreement is governed by the laws of the State of California and applicable U.S. federal laws.

Superpower Confidence Program – Additional Terms

The following terms apply specifically to the Superpower Confidence Program (the “Program”), a digital educational product offered by NextStarz. These terms are in addition to, and not in replacement of, the Terms of Service above. In the event of a conflict, these Program-specific terms shall control with respect to the Superpower Confidence Program.

Program Access & Household Use

Access to the Superpower Confidence Program is granted to one (1) household per purchase.

• A “household” is defined as the purchasing parent or legal guardian and their minor child(ren) residing in the same household.

• Access is limited to use by the purchaser and their minor child(ren) only.

• Account sharing, credential sharing, sublicensing, resale, or transfer of access outside the purchasing household is strictly prohibited.

Any attempt to share access, distribute login credentials, or allow use by individuals outside the purchasing household may result in immediate termination of access without refund.

Relationship to the Academy & Community

The Superpower Confidence Program is a standalone educational product.

• Access to the NextStarz Community is included only through an active subscription to the NextStarz Academy.

• Purchasing the Superpower Confidence Program does not automatically grant access to the Community unless explicitly stated at the time of purchase.

• Community access is governed by the Academy terms and Community guidelines outlined above.

Intellectual Property & Ownership

All materials included in the Superpower Confidence Program—including but not limited to:

• Videos

• Audio recordings

• Visualizations

• Written lessons

• Exercises

• Worksheets

• Illustrations

• Characters, concepts, metaphors, terminology, routines, and frameworks

are the exclusive intellectual property of NextStarz and are protected by U.S. and international copyright, trademark, and intellectual property laws.

This includes, without limitation:

• Program structure and lesson sequencing

• Confidence routines, breathing techniques, cueing systems, phrases, and frameworks

• Original illustrations, characters, graphics, and animations

You are granted a limited, non-exclusive, non-transferable, revocable license to access and use these materials solely for personal, non-commercial use within your household.

You may not:

• Copy, reproduce, record, or redistribute Program content

• Share screenshots, recordings, or downloads outside your household

• Use the content to create derivative works, coaching programs, or competing products

• Sell, license, or publicly display Program materials in any form

Unauthorized use, reproduction, or distribution constitutes a material breach of this Agreement and may result in termination of access and legal action.

No Coaching, Medical, or Therapeutic Relationship

The Superpower Confidence Program is an educational resource only.

Participation does not create a coach-client, therapist-client, medical, or fiduciary relationship between you (or your child) and NextStarz or its coaches.

The Program is not intended to diagnose, treat, or replace professional medical, psychological, or therapeutic care.

Termination for Misuse

NextStarz reserves the right, in its sole discretion, to suspend or terminate access to the Superpower Confidence Program if we determine that:

• Account sharing has occurred

• Intellectual property rights have been violated

• Program materials are being misused or redistributed

• These Terms have been breached

Termination under this section will be without refund.
