Privacy Policy

NEXTSTARZ ("Company," "we," "us," or "our") respects your privacy and is committed to protecting the personal information of our customers and their families. This Privacy Policy explains how we collect, use, share, and protect information when you visit our websites, purchase or use our products and services, or communicate with us, including through our text-messaging (SMS) programs.

This Privacy Policy is incorporated into and forms part of our Terms of Service. By using any NextStarz website, product, or service, you agree to the practices described in this Privacy Policy.

1. Information We Collect

Information you provide to us, including:

Name, email address, and phone number;
Your child's (player's) first name, where you choose to provide it;
Account login and profile information;
Payment information, which is collected and processed by our payment processors (Kajabi Payments and Stripe).
Content you submit, such as form responses, messages, survey or quiz answers, and any photos or videos you choose to upload; and
Communications you send to us, including support and email correspondence.

Information we collect automatically when you use our websites or digital products, including:

Device and browser information, IP address, and general location;
Usage data, such as pages viewed and links clicked; and
Information collected through cookies, pixels, and similar tracking technologies (see Section 7).

2. How We Use Your Information

We use the information we collect to:

Provide, deliver, and maintain our products and services, including delivering subscription content by text message;
Process payments, subscriptions, and renewals;
Create and manage your account;
Send you transactional and account-related communications;
Send you marketing communications by email and, where you have opted in, by text message;
Respond to your inquiries and provide customer support;
Measure, analyze, and improve our products, services, and marketing;
Deliver and measure advertising (see Section 6); and
Comply with legal obligations and enforce our Terms of Service.

3. Text Messaging (SMS) Privacy

This section applies to information collected in connection with our text-messaging programs.

We will not share, sell, or rent your mobile phone number, SMS opt-in information, or consent status with any third parties or affiliates for their own marketing or promotional purposes.

Mobile information collected for text messaging is used solely to operate our text-messaging programs — for example, to deliver the messages you signed up for and to honor opt-out requests. We may share this information only with the vendors and service providers that help us deliver those text messages on our behalf (such as our SMS platform and automation tools), and only for that purpose. Text messaging originator opt-in data and consent are excluded from all other information-sharing categories described in this Privacy Policy and will not be shared with any third parties.

4. How We Share Information

We do not sell your personal information in the traditional sense. We may share information in the following limited circumstances:

Service providers. We share information with vendors who perform services on our behalf, such as website hosting and course delivery (Kajabi), payment processing (Kajabi Payments and Stripe), text-message delivery (our SMS platform), automation and data transfer (Zapier), and analytics and advertising providers (see Sections 6 and 7). These providers are permitted to use the information only to provide services to us.
Legal and safety. We may disclose information where required by law, to respond to legal process, to protect the rights, safety, or property of NextStarz or others, or as described in our Terms of Service regarding mandatory reporting of suspected harm to a child.
Business transfers. If NextStarz is involved in a merger, acquisition, or sale of assets, information may be transferred as part of that transaction, subject to this Privacy Policy.

As stated in Section 3, your SMS opt-in data and consent status are never shared with third parties for marketing purposes.

5. Children's Privacy (COPPA)

NextStarz products and services are intended to be purchased and managed by parents and legal guardians, not by children. We do not knowingly collect personal information directly from children under the age of 13 without verifiable parental consent.

All accounts, purchases, form submissions, and content uploads must be created and managed by a parent or legal guardian. Where a parent provides limited information about a minor (such as a player's first name), it is provided voluntarily by the parent and used only to personalize the family's experience.

If you believe we have inadvertently collected personal information from a child under 13 without proper parental consent, please contact us immediately at [info@nextstarz.com], and we will take steps to delete that information.

6. Advertising & Analytics

We use third-party advertising and analytics services, including Meta (Facebook/Instagram) and Google Analytics, to measure the performance of our marketing, understand how customers find and use our products, and deliver relevant advertising.

These services may use cookies, pixels, and similar technologies, and we may share certain contact information (such as hashed email addresses) with advertising platforms to measure conversions and build marketing audiences. We do not use mobile phone numbers collected for our text-messaging programs for third-party advertising audience-building, consistent with Section 3.

You can opt out of certain interest-based advertising through your device or browser settings, through the advertising platforms' own controls (for example, your Meta and Google ad settings), and through industry tools such as the Digital Advertising Alliance's opt-out page.

7. Cookies & Tracking Technologies

We use cookies and similar tracking technologies (including pixels and analytics tools) to operate and improve our websites, products, services, and marketing. Cookies help us remember your preferences, keep you logged in, understand site usage, and measure advertising.

By using our websites or digital products, you consent to our use of cookies as described here. You may manage your cookie preferences through any consent management tool we provide or through your browser settings; however, disabling certain cookies may affect the functionality of our products and services.

8. California Privacy Rights (CCPA/CPRA)

9. Data Retention

We retain personal information for as long as necessary to provide our products and services, maintain your account, comply with our legal obligations, resolve disputes, and enforce our agreements. When information is no longer needed, we take reasonable steps to delete or de-identify it.

10. Data Security

We use reasonable administrative, technical, and physical safeguards designed to protect personal information. However, no method of transmission or storage is completely secure, and we cannot guarantee absolute security.

11. Your Choices

Email marketing. You may unsubscribe from marketing emails at any time using the unsubscribe link in any email.
Text messages. You may opt out at any time by replying STOP to any message (see Section 3).

Our websites and products may contain links to third-party websites or services that we do not control. This Privacy Policy does not apply to those third parties, and we encourage you to review their privacy policies.
