Service Agreement & Terms:

1. Nature of Services

NextStarz provides educational coaching and mentorship services focused on athletic mindset, leadership, and performance development. These sessions are not clinical therapy, counseling, or mental health services and are not intended to diagnose, treat, or prevent any medical or psychological condition.

2. Eligibility & Parental Consent

All participants under age 18 must have a parent or legal purchase the program and provide consent for participation. A parent or legal guardian agrees to all terms herein and remains responsible for scheduling, communication, and policy compliance, including but not limited to intellectual property terms contained herein or otherwise noted on materials or in accordance with intellectual property law, including copyright or trademark laws.

3. Session Recording & Privacy

To support athlete growth and ensure quality of service, some coaching sessions may be recorded for internal review and to allow the parent/guardian access for personal replay.

By enrolling, you acknowledge and agree to the following:

Sessions may be recorded and privately shared with your family only.

Recordings are stored securely and will never be published or distributed publicly without written permission.

You may request to opt out of session recording or request deletion of a recording at any time by contacting support.

These recordings are for educational use only and will never replace therapy or medical advice.

4. Scheduling & Expiration

Coaching sessions must be scheduled using the link provided upon purchase.

All sessions must be used, meaning all sessions must take place, within 90 days of purchase.

Missed or no-show sessions are non-refundable and forfeited.

5. Payment

The payment amount will be specified at check-out, according to NextStarz’s listed prices as of the date of purchase, subject to specials or codes that are valid at the time of purchase.

6. Refund Policy

All purchases are final. No refunds will be given for missed sessions, lack of use, or change in interest, subject to the following:  

- If you need to reschedule, you must notify us at least 24 hours in advance of your scheduled session.

- Missed sessions or cancellations with less than 24-hour notice will not be rescheduled.

- Exceptions may be considered only in documented emergency situations and at the sole discretion of NextStarz.

 7. No Guarantees or Medical Claims

Results or outcomes are not guaranteed and will vary by individual effort, consistency, and application of tools discussed. Any testimonials reflect personal experiences and are not promises of future performance.

8. Intellectual Property

All content, including tools, videos, and materials shared with or otherwise distributed to the participant or parent(s) or legal guardian(s) of the participant are the sole property of NextStarz. No one, including but not limited to the participant or parent(s) or legal guardian(s) of the participant, may copy, distribute, sell, offer, reuse, or otherwise utilize this content or any protected component of this content, outside the intended purpose of the individually purchased and individually attended sessions without written permission. The intended purpose of all sessions solely concerns the personal benefit of the individual participant and/or their parent(s) or legal guardian(s).

9. Conduct Expectations

Respectful communication is expected from parents, legal guardians, and participants. Inappropriate or disrespectful behavior, including harassment, foul language, or failure to comply with scheduling policies, may result in removal from the program without refund.

10. Limitation of Liability

The Client releases NextStarz, its coaches, affiliates, and staff from all liability for injuries, damages, or losses incurred during participation. Parent(s) and/or legal guardian(s) voluntarily participate and assume full responsibility.

11. Governing Law

This Agreement is governed by the laws of the State of California, with all disputes to be resolved in San Diego County, CA.

12. Overall

If any clause, term, and/or provision of this agreement is found to be invalid, illegal, or otherwise unenforceable by a court or governmental authority of competent jurisdiction, then such portion will be deemed to be stricken, and the remainder of the document shall continue in full force and effect.

13. Final agreement

This is the final agreement between NextStarz, to be carried out including but not limited to through its coaches, affiliates, and staff. Additions or modifications to this agreement must be made in writing, agreed upon by both parties, meaning NextStarz and a parent or legal guardian of any participant.

By completing your purchase, you acknowledge that you have read, understood, and agree to abide by these terms and conditions. You also confirm that you are legally authorized to enroll yourself (including that you are at least 18 years of age) or your child or legal ward in this program.
